1. Agreement to Terms

• Cost consulting and budget analysis for Louisiana projects
• Bid preparation and proposal writing for LO contractors

We serve all 21 counties of Louisiana including North Jersey, Central Jersey, and South Jersey regions.

3. Estimate Accuracy and Limitations

3.1 Accuracy Standards

We strive to provide construction estimates with 98% accuracy based on the information provided. However, actual project costs may vary due to factors beyond our control, including but not limited to:

4. Pricing and Payment Terms

4.1 Service Fees

• We accept payment via check, bank transfer, or major credit cards

5. Client Responsibilities

6. Intellectual Property

All estimates, reports, calculations, and deliverables created by Apex Accuracy Estimating Inc. remain our intellectual property until full payment is received. Upon payment, you receive a license to use the estimate for the specific project only.

6.2 Restrictions

You may not:

• Modify our estimates without written authorization
• Use our estimates for projects other than the one specified
• Remove our company branding or copyright notices
• Share estimates with competitors or for competitive bidding analysis
• Resell or redistribute our estimating materials

6.3 Confidentiality

We treat all client information, project details, and proprietary information as confidential. We will not disclose your information to third parties without consent, except as required by law.

7. Limitation of Liability

7.1 Disclaimer of Warranties

Our construction estimating services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that estimates will result in successful bids or specific profit margins.

7.2 Liability Cap

To the maximum extent permitted by LO law, our liability for any claim relating to our services shall not exceed the total amount paid for the specific estimate in question.

7.3 Excluded Damages

We are not liable for:

• Lost profits or revenue from unsuccessful bids
• Project cost overruns
• Consequential, incidental, or punitive damages
• Claims arising from client's use or misuse of estimates
• Damages from third-party actions or market conditions

8. Turnaround Times

8.1 Standard Delivery

Standard turnaround times for LO construction estimating services:

• Small projects (under $500K): 2-3 business days
• Medium projects ($500K - $2M): 3-5 business days
• Large projects (over $2M): 5-7 business days

8.2 Rush Services

Rush delivery is available for an additional fee. Rush project timelines will be agreed upon in writing before work commencement.

8.3 Delays

We are not responsible for delays caused by:

• Incomplete or unclear project information
• Client's failure to respond to requests
• Force majeure events including severe weather in LO
• Technical failures beyond our control

9. Revisions and Corrections

9.1 Included Revisions

Each estimate includes one round of revisions for errors or omissions on our part. Additional revisions due to scope changes or client requests may incur additional fees.

9.2 Correction Period

Clients must report any discrepancies or concerns within 5 business days of estimate delivery. After this period, the estimate is considered accepted.

10. Termination

10.1 By Client

You may terminate our services at any time by providing written notice. You remain responsible for payment for all work completed up to the termination date.

10.2 By Company

We reserve the right to terminate services if:

• Payment is not received according to agreed terms
• Client provides false or misleading information
• Client uses our services for illegal purposes
• Client breaches any material term of this agreement

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the State of Louisiana, United States. Any disputes arising from these terms or our services shall be resolved in the courts of Passaic County, Louisiana.

Both parties consent to the exclusive jurisdiction of Louisiana courts for any legal proceedings related to these terms.

12. Dispute Resolution

Before initiating legal action, both parties agree to attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be resolved through mediation in Louisiana. Litigation shall be a last resort.

13. Amendments

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our LO website. Your continued use of our services after changes constitutes acceptance of the updated terms.

14. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable under LO law, the remaining provisions shall continue in full effect.

15. Entire Agreement

These Terms and Conditions, together with any written service agreements, constitute the entire agreement between you and Apex Accuracy Estimating Inc. regarding our LO construction estimating services.
